Sadly this is not always true. The contract of insurance contains certain warranties and\u00a0<\/span><span>conditions that need to be adhered too before the insurer will indemnify the client. This \u2018small print\u2019\u00a0<\/span><span>is often ignored and can result in an unexpected, repudiation of the \u00a0claim. This can be catastrophic\u00a0<\/span><span>to small and medium sized fleet owners.<\/span><\/p>\n<p>I will attempt to highlight some of the more frequent causes of claims being rejected by insurers.<\/p>\n<p><strong>Maintenance<\/strong> \u2013 Every policy wording has a clear condition that all vehicles must be maintained to a\u00a0<span>roadworthy condition. This includes brakes and tyres. If one has to look at the findings of the Brake\u00a0<\/span><span>and Tyre watch, whom carry out random checks of trucks using our roads, more than 60% of all \u00a0<\/span><span>trucks fail this critical check. \u00a0An un-roadworthy vehicle will allow the insurer to repudiate any claim\u00a0<\/span><span>here they feel the un-roadworthiness contributed to the accident.<\/span><\/p>\n<p><strong>Tracking devices<\/strong> \u2013 Where the vehicle value is over a certain amount, most Insurers require an\u00a0<span>approved tracking device. They also state that this device must be operational at the time of the\u00a0<\/span><span>accident. In the event of a theft or hijacking, the insurer will certainly check to see if the unit was\u00a0<\/span><span>functional. If for any reason the unit was not working at the time of the event, they are likely to\u00a0<\/span><span>repudiate the claim.<\/span><\/p>\n<p><strong>Overloading<\/strong> \u2013 Because of the effect that overloading can have on a vehicle\u2019s driving performance,\u00a0<span>most insurers have a zero tolerance for overloading. This is often beyond the control of the owner,\u00a0<\/span><span>but could still have a negative impact at the time of a claim.<\/span><\/p>\n<p>There are many other warranties and conditions, but the above three are the most common causes\u00a0<span>of repudiation. Others include &#8211; drunken drivers, unpaid premiums, and incorrect or inadequate\u00a0<\/span><span>information provided to the insurer regarding the risk or dishonesty regarding the claim.<\/span><\/p>\n<p>A very important tool to ensure that a fleet owner avoids the above pitfalls is the Road Transport\u00a0<span>Management System (RTMS). This is a self-regulating standard, similar to an ISO standard, which\u00a0<\/span><span>focuses on safety and compliance. This standard forces fleet owners to develop a set of sound\u00a0<\/span><span>operational practices that allow for the monitoring and managing of key safety and efficiency areas.\u00a0<\/span><span>A small price to pay to avoid a crippling Insurance repudiation.
